The notice applies to the processing of personal data in connection with the portals accessible at https://www.portlessboats.com and the related subpages and websites belonging to the scope of interest of Portless International Limited Liability Company (hereinafter: Portless International Kft.) (hereinafter collectively: portals).

Portless International Kft. is the data controller for all data processing in connection with the portals. Portless International Kft. is committed to the protection of personal data; this notice summarizes the methods of data collection and processing, as well as information on the exercise of data subject rights related to data processing, in this spirit. The notice is reviewed from time to time, and Portless International Kft. publishes the fact of the amendment, indicating the amended provisions, on the https://www.portlessboats.com portal.

PRINCIPLES OF DATA PROCESSING

Portless International Kft. processes all data qualifying as personal data in accordance with the principles of lawfulness, fair procedure, transparency, and data minimization. Data processing is purpose-bound; Portless International Kft. only conducts data processing if one of the legal bases specified in this notice exists, and only for the duration of the validity of the legal basis.

Portless International Kft. does not use the data for profiling, does not transfer them to third parties – except in the case of official or judicial requests indicating the legal basis, or for potential legal enforcement, whether domestically or abroad – and only uses the data processors specified in this notice during data processing.

Portless International Kft. protects the data with appropriate, risk-proportionate technical and organizational measures, handles any data protection incidents that may arise in accordance with the GDPR requirements, and provides information to the affected parties – in the manner and with the content prescribed by law.

SCOPE OF DATA PROCESSING, RANGE OF PROCESSED DATA

Viewing the information shared on the portals does not require the provision of personal data; this is only necessary in the case of using the following services requiring registration or initiating contact with Portless International Kft.

During the downloading and viewing of the portals, however – in accordance with the provisions of this notice – we monitor the visitors’ activities, during which we also collect personal data.

For services requiring registration (e.g., signing up for a test drive) or initiating contact – if you give your prior consent to data processing – the following data must be provided: the data subject’s name, electronic mailbox address, telephone number.

The data subject is free to decide on providing the above data; however, in the absence of data processing consent or at least partial provision of the data, some of the services may not be available, or the contact may fail.

In addition to the above, Portless International Kft. collects information about the IP addresses used to access the portals (the IP address is a unique network identifier that enables computers to communicate over the internet), operating systems, browsers, the time and duration of viewing, as part of monitoring visitors. The collected information qualifies as personal data if it allows the indirect or direct identification of the natural person data subject.

The portals use so-called cookies, information identifiers installed and stored in the users’ browsers for a specified validity period, to improve the user experience. The use of cookies enables tracking of users’ website usage habits, recognition of returning users, and linking of browsing histories related to the given website. Cookies themselves are not capable of identifying users; they only enable the recognition of the user’s browser. The portals use cookies only when the user downloads and views the portals. Portless International Kft. does not use cookies to identify users who are merely visitors to the websites. Users can set the rules for the application of cookies in their browsers or disable the use of cookies (more information on cookie settings can be found in the user documentation of the browsers).

NEWSLETTER SUBSCRIPTION

The personal data provided during subscription to the newsletter are used solely for the purpose of sending you newsletters via email based on your consent. For this, we need your email address and additional information (see below) that allow us to verify that you are the owner of the provided email address and have consented to the newsletter subscription.

We use this data solely for sending the information you have indicated and do not forward it to third parties. We commission data processors for sending the newsletters, who undertake to comply with the applicable data protection regulations under contract.

When you visit one of our websites that contains plugins, your browser establishes a direct connection with the Facebook, Instagram, or Google server. The plugin content is transmitted directly to your browser by the respective provider and integrated into the page. Due to the integration of the plugins, the provider receives information that your browser has loaded the corresponding page, even if you do not have a profile or are not logged in. This information (including your IP address) is transmitted directly from your browser to the provider’s server in the USA and stored there.

If you are logged in to one of the providers, the providers can assign your visit to our website to your Facebook, Instagram, YouTube, or Google+ profile. GOOGLE ANALYTICS

This page uses the Google Analytics web analysis service of Google Inc. (“Google”). Google Analytics uses so-called “cookies,” files stored on your computer that enable the analysis of your use of the website. The information generated by the cookies about your use of the website is usually transmitted to a Google server in the USA and stored there.

However, due to the activation of IP anonymization on this page, Google shortens your IP address within the member states of the European Union or other contracting states to the Agreement on the European Economic Area beforehand. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. Use of the retargeting function
Display of targeted advertisements using “retargeting.”

This page uses so-called “retargeting tags.” Retargeting tags are JavaScript elements located in the website’s source code. When a user visits a page that contains a retargeting tag, the online advertising provider (e.g., Google) places a cookie on the user’s machine and assigns it to the appropriate retargeting target group list. The task of these cookies is to activate retargeting campaigns (targeted advertisements) on other websites. Studies show that the use of targeted advertisements is much more interesting for internet users than advertisements in which they are not directly interested or not related to the visited pages.

Settings and deactivation options Third parties – including Google – use cookies to activate advertisements based on the user’s previous visits to our website, but do not store personal data. Users of these websites can disable the use of cookies through Google by loading the “Google Ad Settings” interface. Users can also disable cookies used by third-party providers by visiting the “Network Advertising Initiative” deactivation page and modifying the necessary settings there.

FACEBOOK PIXEL

Remarketing tags from the Facebook social network are also placed on our pages (1601 South California Ave., Palo Alto, CA 94304, USA). When you visit our pages, the remarketing tags establish a direct connection between your browser and the Facebook server. Facebook receives the data with your IP address. As a result, Facebook can assign our visited pages to your user account. We can use this information to display Facebook ads. We note that as the page provider, we do not know the content of the transmitted data or its use by Facebook. LEGAL BASIS AND PURPOSE OF DATA PROCESSING

Data processing in connection with the portals is always based on the consent of the data subject and the legitimate interest of Portless International Kft. Thus, the legal basis for data processing is Article 6(1)(a) GDPR, the consent of the data subject; and Article 6(1)(f) GDPR, the enforcement of the interests of Portless International Kft.

The purpose of data processing is contacting potential partners and clients of Portless International Kft., maintaining contact, handling comments and inquiries; sharing information; and ensuring the lawful and secure operation of the portals, integrity protection; ensuring the enforcement of rights related to shared intellectual products under copyright protection and trademarks.

Within the framework of information sharing, Portless International Kft. may also share marketing-related information about the company’s products and services with its partners. If the data subject does not wish to receive marketing-related information, they have the opportunity to block marketing-related information sharing through the contact details specified in this statement.

DURATION OF DATA PROCESSING

Portless International Kft. processes the data until the withdrawal of the data subject’s consent; in the case of relevant purposes, until the existence of the related legitimate interest; or until notification of changes in the contact details.

DATA SUBJECT RIGHTS

In accordance with Chapter III of the GDPR, the data subject has the right to receive information about the circumstances and characteristics of data processing (the identity and contact details of the data controller; the legal basis and purpose of data processing; the duration of data processing; their rights, especially the right to withdraw consent; the possibility of lodging a complaint); request information from the data controller regarding data processing; request access to personal data concerning them; exercise the right to data portability; request the rectification, erasure (right to be forgotten), or restriction of processing of data concerning them; and object to the processing of their personal data.
In the case of unjustified repeated or multiple exercises of the right of access and data portability, the data controller may charge an administrative fee. A prerequisite for exercising the right of access and data portability may be the provision by the data subject of a suitable secure data carrier for storing the data. The data controller provides access and data portability in the format and technological parameters used during data processing.

In the event of a violation related to data processing, the data subject may turn to the tribunal competent according to the registered office of Portless International Kft. or their place of residence or stay. In the course of data processing in connection with the portals, Portless International Kft. uses the following data processors and services:
Portless International Kft. uses the Google Analytics service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; www.google.com/contact) to analyze the operation of the portals. Google Analytics is based on the use of cookies; the information generated by the cookies regarding usage is transmitted to Google’s own servers, stored, and processed there. The IP address anonymization service is active on the portals, so within the member states of the European Union or contracting states to the European Economic Area, Google makes the users’ IP addresses unsuitable for identification before transmission. The user can prevent Google Analytics from collecting and processing data generated by cookies in connection with the use of the portals by downloading and installing the plugin available at http://tools.google.com/dlpage/gaoptout.

Portless International Kft. uses the Google AdWords service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; www.google.com/contact) to support its advertising campaigns. Google AdWords enables the tracking and measurement of the effectiveness of Google advertising campaigns. Google AdWords also uses cookies for its operation, and the general notes on disabling cookies apply to disabling them.
